Welcome to WhattaEat Inc. (“we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of the WhattaEat web application (“App”). By accessing or using our App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
You must be at least 13 years old to use the App. By registering an account, you agree to provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms. You agree not to use the App for any unlawful or prohibited activities.
You may submit reviews, ratings, or other content (“User Content”) through the App. You retain ownership of your User Content but grant us a worldwide, royalty-free, sublicensable license to use, reproduce, and display it in connection with the App. You represent and warrant that you have all rights necessary to grant this license and that your User Content does not violate any third-party rights.
You agree not to post or transmit any content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable. You also agree not to engage in any behavior that disrupts or interferes with the App or its users.
The restaurant information and data provided through the App are collected from various sources and are for informational purposes only. While we strive for accuracy, we do not guarantee the completeness or reliability of this data and disclaim any liability for errors or omissions.
The App is provided “as is” without warranties of any kind, either express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, we shall not be liable for any damages arising from your use of the App.
We may suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.
You agree to indemnify and hold harmless WhattaEat Inc., its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of the App or violation of these Terms.
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on the App. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in California.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
These Terms constitute the entire agreement between you and WhattaEat Inc. regarding the use of the App and supersede all prior agreements.
